Terms & Conditions

These terms govern the sale of goods by Shipping Solutions PTY (“we”, “us”, “our”) to you, and your use of shippingsolutionspty.com. Please read them before placing an order.

1. Acceptance

By using our website, requesting a quote or placing an order, you accept these terms together with our Delivery & Shipping, Refund & Returns, Payment, GST & Tax Invoice and Privacy policies. If you order on behalf of a company, trust or other entity, you warrant that you are authorised to bind that entity.

2. Quotes and pricing

All prices are in Australian dollars (AUD) and include GST unless clearly stated otherwise. Prices shown on the website apply to the configuration and location shown at the time of ordering.

Written quotes are valid for 14 days unless the quote states otherwise. Container prices move with stock availability, exchange rates and transport costs, so a lapsed quote must be re-confirmed.

We take care to publish accurate prices, specifications and images. Where an obvious pricing or description error occurs, we may cancel the affected order and refund you in full rather than supply at the erroneous price. Photographs are illustrative unless the listing states they are of the actual unit.

3. Order acceptance and formation of contract

Your order is an offer to buy. It becomes a binding contract only when we send a written order confirmation, or when we dispatch the goods, whichever happens first. An automated acknowledgement of your order or payment is not acceptance.

We may decline an order — and refund any money paid — where the goods are unavailable, where a pricing or listing error has occurred, where we cannot safely deliver to your site, or where we reasonably suspect fraud.

4. Payment

Payment is by direct bank transfer (EFT) to the account shown on your invoice, using your invoice number as the reference. Full cleared payment is required before dispatch unless agreed otherwise in writing. Modified, custom and special-order units require a deposit before work starts. Hold periods and deposit rules are set out in our Payment Policy.

5. Title and risk

Until title passes, you must not sell, modify, encumber or part with possession of the goods. You are responsible for insuring the goods from the time risk passes.

6. Delivery

Delivery is by tilt-tray or side-loader truck, with crane assistance where quoted. Delivery is a flat $350, GST inclusive, to any address in Australia, with no distance, postcode, state, rural, remote or fuel loading, and takes 7 to 10 days from order confirmation. That single window covers the whole journey from order to arrival and applies equally to every destination state and territory. It is an estimate given in good faith, not a contractual delivery date, and we are not liable for delays beyond our reasonable control.

You are responsible for site suitability and access, for having someone present to accept and direct placement, and for obtaining any council approval, permit or landlord consent needed to place or keep the unit. Where a delivery fails for reasons within your control, redelivery fees apply.

7. Container condition and grading

New (one-trip) containers have made a single cargo voyage and may show minor transit marks and small dents. Used containers are sold in their existing condition and by grade; surface rust, patch repairs, dents, mismatched paint, previous owner markings and floor staining are normal and are not defects.

Where a unit is described as wind and watertight, it will meet that standard on delivery. Unless expressly agreed in writing, we make no representation that a container is suitable for habitation, food or chemical storage, structural stacking, marine cargo carriage or any other specific use, and we do not warrant compliance with any building code or planning instrument.

Refrigerated containers are supplied with the refrigeration unit tested and reported at the time of sale; a suitable power supply, ventilation and ongoing servicing are your responsibility. Any modification you carry out after delivery, and any use of the unit for a purpose we did not agree to, is at your own risk.

8. Limitation of liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

To the extent permitted by law:

• where the goods are not of a kind ordinarily acquired for personal, domestic or household use, our liability for breach of a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing any of those things;
• we are not liable for indirect or consequential loss, loss of profit or revenue, hire of substitute equipment, or damage to driveways, lawns, paving, services or underground infrastructure arising from a delivery you directed;
• our total aggregate liability arising out of any order is limited to the amount you paid for the goods to which the claim relates.

You indemnify us against loss we suffer as a result of your breach of these terms, your failure to obtain a required approval, or unsafe or inaccurate site information you provide.

9. Intellectual property

All content on our website — text, photographs, drawings, specifications, layout, logos and branding — is owned by or licensed to Shipping Solutions PTY and protected by the Copyright Act 1968 (Cth). You may view and print pages for your own use in making a purchase. You may not copy, republish, scrape or resell our content without our written permission.

10. Website use

You agree not to interfere with the operation or security of our website, to submit false information, or to use the site for any unlawful purpose. We do not guarantee uninterrupted availability, though we take reasonable steps to keep the site running and accurate.

11. Governing law and jurisdiction

These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them.

12. Dispute resolution

If a dispute arises, please raise it with us first — most issues are resolved quickly by phone or email.

1. Send written notice to sales@shippingsolutionspty.com setting out what happened, your order number and the outcome you seek.
2. We will acknowledge within 5 business days and respond substantively within 20 business days.
3. If we cannot agree, either party may refer the dispute to mediation by a mediator agreed between us, with costs shared equally.
4. You are always free to contact your state or territory consumer protection agency, or to take the matter to a court or tribunal. Neither party is prevented from seeking urgent injunctive relief.

13. General

If any provision is found to be unenforceable, it is severed and the rest continues to apply. Our failure to enforce a term is not a waiver of it. We may update these terms at any time; the version published when you place your order applies to that order.
